Donor Terms and Conditions

1. Acceptance of Terms and Conditions
By making a donation to Berea College through this Engaging Networks page, you agree to be bound by the following terms and conditions. Please read these terms carefully before making a donation. If you do not agree with these terms, please do not make a donation.
2. Donations
2.1. Donations to Berea College are voluntary contributions made by you, the donor, and do not entitle you to any goods, services, or control of the college’s mission and operations.
2.2. Donations may be made through various means, including but not limited to cash, credit card, check, electronic funds transfer, or any other method accepted by Berea College. For a current list of ways to donate to the college, please visit https://www.berea.edu/giving/ways-to-give.
2.3. Berea College reserves the right to refuse any donation for any or no particular reason, and it will not accept donations that are illegal, unethical, contrary to the college’s Great Commitments or that could harm the college’s reputation.
2.4. In order to make your online donation you will be required to provide Berea College information regarding your credit card or other payment instrument (“Payment Instrument”). You represent and warrant to Berea College that such information is true and that you are authorized to use the applicable Payment Instrument. Your Payment Instrument will be processed through a website, widget, popup window, or other web interface (each a “Donation Window”). You authorize Berea College to charge the Payment Instrument the amounts reflected in the Donation Window.
2.5. Berea College uses Engaging Networks for processing your Payment Instrument for any donations made, and you acknowledge that by making a donation you agree to the processing, use, transfer or disclosure of data by our payment processors pursuant to any and all applicable terms set forth by our payment partners in addition to these Terms.

3. Tax Deductibility
3.1. Berea College is an IRS-designated 501(c)3 non-profit organization. Donations to Berea College are tax deductible to the extent allowed by law. It is your responsibility to determine the tax deductibility of your donation and to keep records of your donation for tax purposes.
4. Use of Donations
4.1. Berea College may use donated funds for the purposes described on its website or in its fundraising materials. Donors have the right to inquire about the use of their donations and, in certain instances, may receive periodic updates on how their contributions have been used.
4.2. Berea College reserves the right to allocate donations to different projects or areas of operation at its discretion if the original project or area becomes overfunded or is no longer viable unless specifically prohibited by the donor at the time the donation was made.
5. Personal Information
5.1. Berea College collects and stores personal information that identifies, relates to, describes, references, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer, business, or household ("personal information") from donors as necessary to process donations, provide acknowledgments for tax purposes, and send communications related to the college.
5.2. You agree that Berea College may share or sell donor information with other non-profit organizations. The college will not share or sell personal information of donors whose donation value exceeds $100.00 to third parties or who are alumni of the college, without the donor's express consent. 6. Communication
6.1. By making a donation, you consent to receive communications from Berea College for the purpose of acknowledging your donation, providing updates on the college’s activities, and informing you of future opportunities to support the college. You can opt out of these communications at any time.
7. Modification of Terms
7.1. Berea College reserves the right to modify these terms and conditions at any time. Any changes will be effective immediately upon posting on the college’s website at https://engage.berea.edu/page/59467/action/1. It is your responsibility to review these terms.
8. Governing Law
8.1. Donations to Berea College and the application of these terms and conditions are governed by the laws of the Commonwealth of Kentucky, without regard to its conflict of laws principles. Any disputes related to the foregoing shall be subject to the exclusive jurisdiction of the state or federal courts situated in Kentucky.
